🔴2. Environmental objection: money is collected, but there is no utilization
- FZ-89 (Art. 24.1) directly states: the RS is introduced "for financial support of utilization". However, there is actually no state program of vehicle scrapping in Russia - only "extended responsibility of manufacturers" (Government Resolution No. 372/2022), which covers <15% of cars retired from service, is in effect.
- According to the Accounts Chamber (Report No. 01-I-124/2024), in 2021-2023, 258 bln. rub. RS, 0.9 bln (<0.4%) was spent directly on utilization activities. The rest was directed to the "common pot" of the federal budget. This is recognized by the Ministry of Finance itself (letter 01-01-36/5/99963 dated 18.09.2024).
- Consequently, the new increase has no environmental justification and contradicts Art. 3, 14 of the Federal Law-7 "On Environmental Protection" and paragraph 1 of Article 16.1 of the Federal Law-89.

🔴3. Legal objection: misuse = article uk
- The fee is collected in accordance with FZ-89 as a special (targeted) payment. Sending it to the Federal budget without a separate budget classification and without an obligation to provide an environmental result:
- violates Articles 161, 165, 170 of the Budget Code of the Russian Federation (earmarking and "gratuitous receipts");
- contains elements of a crime stipulated by:
- Art. 285 of the Criminal Code of the RF ("Abuse of official powers") - when making decisions contrary to FZ-89;
- Art. 160 of the Criminal Code of the RF ("Misappropriation or embezzlement") - if the money is not used for its intended purpose;
- Article 293 of the RF Criminal Code ("Negligence") - when causing major damage to citizens and the budget (over 7 million rubles - part 2).
- For comparison: in 2023, RS revenues exceeded 110 bln rubles; damage to the state and citizens (in the form of unreceived environmental effect and overpayment for cars) is estimated at tens of billions, i.e. "especially large" size (>30 mln rubles).

🔴4. Antimonopoly objection: pressure on competition
- Preservation of full RS compensation only for AVTOVAZ, Sollers, KAMAZ-Motorinvest and part of Chinese factories (Chery, FAW, Haval) simultaneously with the growth of import duty creates unequal conditions and violates Articles 13, 15 of the Law "On Protection of Competition" (market-distorting subsidies).

- According to the WTO rules (for the sake of which rules they introduced scrappage!) (GATT, Art. III:2), taxes/fees should not exceed domestic analogs; actual compensation by the Russian plant makes the effective RS rate equal to zero.
